Privacy Policy

This policy explains how Mensagens handles information connected to business messaging programs, including SMS, MMS, RCS, WhatsApp, Apple Business Messaging, and similar customer communication channels.

Scope

This Privacy Policy applies when you opt in to receive messages from Mensagens or otherwise communicate with Mensagens through a supported messaging channel. If Mensagens helps another organization design or operate its own messaging program, that organization should provide its own privacy policy for its messages.

Information we collect

Mensagens does not buy, rent, or collect marketing lists. We do not collect marketing information from data brokers. We collect only the information needed to communicate with you, provide services, maintain consent records, and comply with applicable messaging rules.

  • Contact information, such as your name, organization, email address, phone number, and messaging handle.
  • Messaging information, such as the channel used, messages sent or received, delivery status, opt-in status, opt-out status, HELP or STOP requests, timestamps, and the source of consent.
  • Service information, such as notes, drafts, brand guidance, or communication preferences you provide when working with us.
  • Basic technical information, such as site logs and device or browser information, when you visit our website or interact with online forms.

How we use information

  • To send messages you requested or agreed to receive.
  • To provide transactional, informational, service, support, or marketing communications, depending on what you opted in to receive.
  • To record, honor, and prove consent, HELP requests, opt-outs, and other messaging compliance events.
  • To respond to questions, provide services, improve our work, prevent misuse, and comply with legal, carrier, and platform requirements.

Mobile information and consent

Mensagens only sends messages when we have consent or another lawful basis to do so. Marketing messages require prior express written consent. Transactional or informational messages require the consent required for that channel, message type, and jurisdiction.

Message frequency varies by program and by your interactions. Message and data rates may apply. Your mobile carrier, device provider, messaging platform, or data plan may apply additional charges or restrictions.

No mobile information, mobile opt-in data, or messaging consent will be shared, sold, rented, or transferred to third parties or affiliates for their own marketing or promotional purposes. Consent for one messaging program is not treated as consent for unrelated programs.

How we disclose information

We may disclose information to service providers that help us operate our website, messaging channels, communications tools, hosting, security, analytics, and compliance workflows. These providers may use the information only to provide services to Mensagens and not for their own marketing.

We may also disclose information if required by law, to enforce our policies, to protect rights and safety, or in connection with a business transaction such as a merger, acquisition, or reorganization. We do not sell or share personal information for cross-context behavioral advertising.

California privacy rights

California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including the right to know, access, delete, correct, and opt out of certain uses or disclosures of personal information.

  • Categories collected: identifiers, customer or business contact records, internet or network activity, professional or business information, communications content you choose to send us, and inferences necessary to honor communication preferences.
  • Sources: you, your organization, messaging platforms, service providers, and our website or communication systems.
  • Purposes: the business and compliance purposes described in this policy.
  • Sale or sharing: Mensagens does not sell personal information or share it for cross-context behavioral advertising. We do not sell or share mobile opt-in data or consent.
  • Sensitive personal information: Mensagens does not use sensitive personal information to infer characteristics.

To exercise a California privacy right, contact help@mensagens.ai. We may need to verify your identity before completing a request. You may also use an authorized agent where permitted by law. We will not discriminate against you for exercising privacy rights.

Retention and security

We keep personal information only as long as reasonably necessary for the purposes described in this policy, including service delivery, consent records, dispute resolution, legal obligations, and messaging compliance. We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.

Children

Mensagens messaging programs are not directed to children under 13, and we do not knowingly collect personal information from children under 13.
