App Terms of Service

These Terms of Service govern your access to and use of the Mensagens mobile apps, member apps, websites, APIs, messaging features, community features, media features, event tools, store features, and related services.

By creating an account, signing in, tapping to accept, or using the services, you agree to these Terms. If you do not agree, do not use the services.

Some communications and opt-in flows are also governed by the Mensagens Privacy Policy, Messaging Terms and Conditions, and any organization-specific notices shown to you.

You may use the services only if you can form a binding contract and are not barred from using the services under applicable law.

If you use the services on behalf of an organization, you represent that you are authorized to do so and that the organization is responsible for your use.

Mensagens may identify your app use through your signed-in account, app install identifier, phone number, email address, device information, and organization or contact records associated with your account.

A contact record may exist in more than one organization. These Terms apply to your use of the Mensagens apps and services, not merely to a single organization contact record.

You are responsible for keeping your sign-in information accurate and for using only phone numbers and email addresses you are authorized to use.

Mensagens helps organizations communicate with members, customers, event participants, store customers, donors, and other contacts. When an organization sends or manages its own communications through Mensagens, that organization is responsible for its message content, recipient relationships, and compliance obligations.

You agree not to use Mensagens to send, request, upload, or distribute unlawful, deceptive, harassing, abusive, infringing, harmful, or unauthorized communications or content.

You may receive transactional, service, event, community, order, support, or other app-related communications. Marketing messages require the consent required by law and by the channel used.

Message delivery is not guaranteed. Carriers, device providers, app stores, and messaging platforms may delay, block, filter, or fail to deliver messages.

• Message and data rates may apply.
• For SMS, MMS, and RCS programs, reply STOP to opt out and HELP for help when supported.
• For platform messaging, use the unsubscribe, block, or help controls provided by that platform when available.

You retain ownership of content you submit, post, upload, or share through the services. You grant Mensagens a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, adapt, and use that content as needed to provide, secure, support, and improve the services.

You must have the rights needed to submit your content. You may not submit content that is illegal, abusive, defamatory, discriminatory, pornographic, exploitative, invasive of privacy, infringing, deceptive, malicious, or otherwise harmful.

Mensagens may remove content, restrict features, suspend accounts, or notify an organization when needed to protect users, comply with law, enforce these Terms, or operate the services.

• Do not interfere with, reverse engineer, scrape, overload, probe, or disrupt the services except as expressly permitted by law.
• Do not bypass access controls or try to access another user's account, organization data, contact data, messages, media, or private content.
• Do not use the services for spam, phishing, malware, fraud, unauthorized marketing, or unlawful surveillance.
• Do not misrepresent your identity, affiliation, consent, or authority to act for another person or organization.

Mensagens handles personal information as described in the Mensagens Privacy Policy and any privacy notice shown for a specific organization or program.

The services may process contact details, device information, app install identifiers, message metadata, content you provide, location information you choose to share, and service logs needed to operate and secure the services.

The services may depend on third-party networks, carriers, app stores, payment processors, cloud providers, maps, messaging platforms, and organization systems. Mensagens is not responsible for third-party services that it does not control.

If you download the iOS app from the Apple App Store, Apple is not a party to these Terms and is not responsible for the Mensagens services, content, support, warranties, claims, or maintenance except as required by applicable App Store terms.

Mensagens may change, suspend, or discontinue features at any time. Mensagens may update these Terms from time to time.

When a new version requires acceptance, Mensagens may require you to review and accept the updated version before continuing to use the apps or services.

The services are provided as is and as available. To the maximum extent allowed by law, Mensagens disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Mensagens does not warrant that the services will be uninterrupted, secure, error-free, or that messages, notifications, uploads, event data, community content, store data, or other information will always be accurate, available, or delivered.

To the maximum extent allowed by law, Mensagens and its owners, employees, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, revenue, business, or use.

To the maximum extent allowed by law, Mensagens' total liability for all claims relating to the services or these Terms will not exceed the greater of the amount you paid Mensagens for the services in the 12 months before the claim or $50.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some limits may not apply to you.

To the extent allowed by law, you agree to defend, indemnify, and hold harmless Mensagens from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your content, your misuse of the services, your violation of these Terms, or your violation of law or third-party rights.

You may stop using the services at any time. Mensagens may suspend or terminate access if it reasonably believes you violated these Terms, created risk for other users or organizations, or used the services in a way that could harm Mensagens, its customers, or third parties.

Sections intended to survive termination, including ownership, user content licenses, disclaimers, limitation of liability, indemnity, and acceptance records, will survive.
